Due to the law representing decree (d.lgs.) 231/2001 all businesses are liable for criminal offences that are executed by law representatives, business executives and staff members during their occupational practice. Also the decree 81/2008, “Unite text about health protection and job safety”, refers to the above mentioned decree.

The designated fines according to the decree 231 for companies are between 25,000 and 1,5 Mio. Euros.

In case of severe offence the suspension of the business activity, the call-back of authorisations, licenses or concessions, the prohibition of negotiations with the public hand and the suspension of financing and contributions can be the consequence.

By introducing an integrated organisation model according to decree 231 the administrative and legal liability of a company can be strongly limited.
